LIMITED UNCLASSIFIED STAFF APPOINTMENTS |
Limited Appointments
Limited appointments (§36.17, Stats. and s. UWS 15, Wis. Adm. Code) are special appointments to designated administrative positions using unclassified titles and are made for persons involved directly in formulating, interpreting, and monitoring policies and/or major programs on behalf of the administrative officer with whom such policies and/or program directions originate. Limited appointees serve at the pleasure of the authorized official who made the appointment, and usually do not have a set period of time.
Regent Resolution #9091 (adopted November 11, 2005) directed that from and after November 11, 2005, limited appointments shall be permitted only for those positions enumerated in §36.17, Stats. (refer to Unclassified Personnel Guideline 2.), unless an institution provides written justification for the creation of additional limited appointments to the UW-System President.
Limited Appointments for Employees WITH Existing UW-Madison Appointments
An employee who holds a UW-Madison faculty, academic staff, or classified appointment prior to the limited appointment carries that type of appointment concurrently as a zero-dollar appointment for the duration of the limited appointment.
PLEASE NOTE: Regent Resolution #9091 directs that the status or length of the term of a concurrent appointment held by a limited appointee may not be altered while the individual is serving in the limited appointment. For clarification purposes, the intent of the resolution is to not improve the status of or increase the term of the concurrent appointment.
Governance Rights
For academic staff appointments, the employee continues to be eligible to vote in academic staff elections and participate in the academic staff governance while in a limited appointment, but is not covered by the Academic Staff Policies and Procedures (ASPP) in the limited appointment. The same is true for faculty employees (see Faculty Policies and Procedures).
Salary Rates
The salary rate for a limited appointment should be separate and distinct from the rate of the pre-existing appointment.
Limited Appointments for Employees WITHOUT Existing UW-Madison Appointments
In accordance with Regent Resolution #9091, limited appointees entering employment at UW-Madison that does not require a concurrent tenure appointment (e.g., Dean) shall not be granted a back-up appointment.
Instead of a back-up that provides a guarantee of employment beyond the end of the limited appointment, the employing unit may provide the limited appointee with a maximum of six months notice of termination at the same salary and title with possible reassignment to other duties.
Limited Appointments for Employees With Existing UW-Madison Appointments
Upon termination of the limited appointment, the employee's zero-percent concurrent appointment (whether it is faculty, academic staff, or classified) becomes the primary position. The appointee has the right to assume the appointment without a separation in service.
Salary
Return to the pre-existing appointment does not require continuance of the limited appointment salary rate. However, the salary shall not be lower than the employee might reasonably have expected if the prior position had continued without interruption (ASPP 2.07).
Appeal Rights
Limited appointees do not have the right to appeal in any manner the decision to end a limited appointment.
Limited Appointments for Employees Without Prior UW-Madison Appointments
Appeal Rights
Limited appointees do not have the right to appeal in any manner the decision to end a limited appointment.
Faculty Concurrent Appointment
If the individual has a faculty concurrent appointment, it will be activated at the end of the limited appointment.
Notice of Termination
If the appointing authority granted a notice of termination (maximum of six months), the employee may be reassigned to other duties during this period.
Resignation From a Limited Appointment
A limited appointee may resign the limited appointment and ask to return to a faculty or academic staff appointment (if applicable).
Such requests should be honored as soon as possible by the authorized official. In the event a position is not readily available, or with agreement of the limited appointee, the authorized official may place the limited appointee on an unpaid leave of absence until a vacancy becomes available.
