Labor Certifications Going to Atlanta Effective 1 June 2008
Effective 1 June 2008, all applications for Permanent Labor Certification from around the country will have to be filed to the Atlanta, Georgia, office of the Department of Labor. This only applies to the applications we file for Permanent Residence for teaching faculty; it does not apply to the LCA for H-1B applications. As part of the filing process, the employing department must re-post the original PVL both on the wall in the department and in the electronic PVL system, according to the instructions on page 7 of the Labor Certification instructions: http://www.ohr.wisc.edu/ifss/PR/labor_Certification_Instructions.doc. All applications that IFSS will file after 1 June 2008 MUST give the Atlanta DOL address in the Additional Information section. If the PVL was posted with the Chicago address, the department will need to post it again, for a minimum of 10 business days. IFSS cannot file the application until 30 days have passed from the end of the 10-day posting. Keep in mind that the Labor Certification MUST be filed within 18 months of the INITIAL offer letter, so departments should take into consideration the additional time for the posting and not leave the application to the last minute. Failure to file within the 18 months would likely necessitate a new national search.
